1. About these terms

These Terms and Conditions govern the sale of products by Cue-Go Limited ("Cue-Go", "we", "us") through cue-go.co.nz and otherwise. By placing an order you accept these terms. We may update them from time to time; the version current when you order applies.

2. Orders and acceptance

Your order is an offer to buy. A contract forms only when we accept your order or dispatch the goods. We may decline or cancel any order at our discretion (for example, where goods are unavailable, a pricing or description error has occurred, or we suspect fraud) and will refund any payment made for a cancelled order.

3. Pricing

Prices are in New Zealand dollars and include 15% GST unless stated otherwise. We take care with pricing but may correct errors at any time before dispatch; if the correct price differs materially we will contact you to confirm or cancel the order.

4. Payment and title

Payment is due in full at checkout, or for approved trade-account customers in accordance with their account terms. Title to the goods remains with Cue-Go until we have received payment in full; risk passes to you on delivery or collection. Overdue amounts may incur interest and reasonable collection costs.

5. Delivery

Delivery is a flat $15 within New Zealand unless otherwise quoted. Delivery timeframes are estimates only and we are not liable for delays outside our reasonable control. Please inspect goods on arrival and notify us promptly of any issue.

6. Returns and refunds

Returns are handled under our Returns Policy. For faulty goods, your rights under the Consumer Guarantees Act 1993 apply. Change-of-mind returns are at our discretion and may be subject to conditions, a restocking fee, and store credit in place of a refund.

7. Warranty

Products carry a minimum 12-month warranty against defects unless stated otherwise, as described in our Warranty Information. Product protection plans and warranty extensions are available. As an authorised reseller, some warranty claims may be assessed or fulfilled by the manufacturer or distributor.

8. Consumer Guarantees Act and Fair Trading Act

Nothing in these terms limits rights that cannot lawfully be excluded. However, where you acquire goods for the purposes of a business, you agree that the Consumer Guarantees Act 1993 and sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, and that it is fair and reasonable that you are bound by this exclusion.

9. Limitation of liability

To the maximum extent permitted by law, Cue-Go’s total liability arising from any order is limited to the price paid for the relevant goods, and we are not liable for any indirect or consequential loss, loss of profit, revenue or data. Nothing in this clause limits liability that cannot lawfully be excluded.

10. Trade accounts and credit

Trade accounts (including for schools and hire companies) are subject to approval and to the terms of your credit application. We may require a credit check, and may vary, suspend or withdraw credit at our discretion. Overdue trade accounts may incur interest and administration fees as set out in your account terms.

11. Cancellations

We may cancel an order and refund you as set out above. You may cancel an order before dispatch, except for special-order or custom-configured items, which may not be cancellable once ordered.

12. Privacy

We collect and handle personal information in accordance with our Privacy Policy.

13. Intellectual property

All content on cue-go.co.nz is owned by or licensed to Cue-Go and may not be used without our permission.

14. Events outside our control

We are not liable for any failure or delay caused by events beyond our reasonable control.

15. Governing law

These terms are governed by New Zealand law and the New Zealand courts have exclusive jurisdiction.

16. General

If any provision is unenforceable, the rest continue to apply. Our failure to enforce a term is not a waiver of it. These terms are the entire agreement between us regarding the sale of goods. Questions? Contact [email protected].
